Travellers may have to leave land

A FAMILY of travellers may have to leave land in Mountnessing after a successful appeal by Brentwood Council.

A planning inspector granted permission for the MacDonald family to stay on the plot of green belt land adjacent to 77 Roman Road in April 2007.

However, following an appeal to the High Court last June, Brentwood Council has learned that it has been successful in having the decision quashed.

The Secretary of State for Local Government and Communities agreed with the council's stance that the original judgement was flawed and that guidance and policies had not been properly adhered to.

Following the ten month-long appeal, His Honour Mr Justice Cranston made an order that the decision be quashed.

The council will also have its costs paid for partly by the Secretary of State and partly by the MacDonald family solicitors.

Brandon Lewis, leader of Brentwood Council, said: "I am delighted that the court has agreed to quash the planning inspector's decision and equally pleased that the council's costs are to paid by the Secretary of State and the travellers' solicitors.

"This is good news for the residents of Brentwood."

A new public inquiry is now expected to take place to reconsider the long-running saga.

The travellers claimed during last year's inquiry to have paid £108,000 for the land in 2001.
